Non-Material Amendment Success

A recent successful Non-Material Amendment demonstrates the value of proactive collaboration and pragmatic decision making within the planning process.

Our client faced a significant challenge where an existing pre commencement condition could not be discharged in time to lawfully implement the planning consent before expiry.

Working closely with Cornwall Council, we secured agreement to amend the wording of the condition and vary the trigger point. This allowed the site to commence in part without prior discharge of the condition, ensuring the permission remained extant.

The Council determined the amendment efficiently, resulting in a positive outcome for all parties and safeguarding the consent from being lost.
