Laurence Associates have recently gained consent for various development proposals within the same site. The applications included a range of application types, being for a Certificate of Lawfulness of Proposed Use or Development, a Certificate of Lawfulness of Existing Use or Development and a discharge of condition (following a successful appeal) showing our range and ability to succeed on differing cases.
The first case was a certificate of lawfulness for a proposed fence, putting forward the case that the erection of a 2m fence would be permitted development. While a relatively simple case, it required understanding of what would be permitted and what wouldn’t navigating the numerous requirements set out by the General Permitted Development Order.
The second case was a certificate of lawfulness to confirm that existing buildings were lawful. We applied the transitional legislation to evidence that the buildings on-site were present for 4 years and were therefore lawful. This required close discussion with the client to ensure enough evidence was available to demonstrate our case on the balance of probabilities.
The final case was to discharge a landscaping condition on an allowed appeal for a new holiday site. This required input from our in-house landscape Architect to ensure suitable species were proposed. It also required careful consideration as to what planting would reflect the area of the site and would blend into the wider surroundings.
All three submissions were approved without delay.
