Planning Appeal Success for Permission in Principle Scheme
Laurence associates have recently been successful in winning another appeal. The scheme was for a Permission in Principle.
The site was set on the edge of a village but was located within the World Heritage Site and had various constraints.
The scheme was initially refused partly on amenity impact, which the Inspector quickly dismissed as having any bearing, but also through the view that the scheme did not align with a specific policy within the Neighbourhood Development Plan due to the number of dwellings being proposed.
However, due to our knowledge and understanding of how a scheme should be balanced, we made the case that while there was slight conflict with the NDP, this should not be the overwhelming reason to refuse a scheme. We made the case that the weight attributed to this should be limited and that this is only one element of the overall consideration. We argued that the scheme complied with other policies within the development plan, as well as highlighting that the scheme could also be supported when engaging the ‘tilted balance’.
The appeal was ultimately allowed, with the Inspector agreeing with our arguments that the scheme was a suitable location for new housing. This positive appeal decision, which is one of many we have recently won, shows our expertise and that a refusal is not always the final outcome.
