We were instructed to submit and negotiate an appeal against planners’ refusal to allow a car parking and turning space within an Area of Outstanding Natural Beauty on the clifftop at Portreath on the north coast of Cornwall, three miles from Redruth.
We prepared a robust case for appeal and submitted it to the Planning Inspectorate: it included references to the technical aspects of the planning application, planning policies, and the presumption in favour of sustainable development.
A Landscape and Visual Impact Assessment had been completed at the planning stage, and reinforced our assertion that the impact would be negligible.
The Appeal was allowed and full costs awarded to our client. The inspector said the proposal was in accordance with national planning policy and the AONB Management Plan, and concluded that it was unreasonable of the Council to delay development.
